Terms of Service

Last updated: October 28, 2026

These terms govern your use of the OwnPBX.org website, the My Phone app, and any PBX service run by the OwnPBX project operator. If you run your own PBX, your own terms with your users apply instead — but the software itself is still provided under the terms below.

1. Acceptance

By using this site, the app, or a project-operated PBX account, you agree to these terms and to the Privacy Policy. If you do not agree, do not use them.

2. What OwnPBX is

In plain language: OwnPBX is software, not a phone company. It does not provide phone service by itself — it connects to a PBX server you run or administer.

OwnPBX is free, open-source software (GPL-2.0-or-later) for running your own private branch exchange: calls, texts, voicemail, and push-to-talk between extensions, plus PSTN connectivity where the server's administrator has configured telephone trunks. The My Phone app is a client for that server. OwnPBX is not a carrier, does not assign public phone numbers by itself, and does not guarantee connectivity to any public network — that depends on the server's trunks and carriers.

3. Accounts: authorized users only

There is no signup. Accounts are created by a PBX administrator, and only authorized users may use the app or a project-operated account. You are responsible for keeping your password, pairing codes, and app PIN private, and for anything done with your account while it is signed in. If you believe your account is compromised, tell the administrator immediately. The administrator may suspend or delete an account that is misused, inactive, or no longer authorized.

4. Acceptable use

Do not use the service to break the law, to harass or threaten anyone, to send spam or robocalls, to impersonate someone else, or to interfere with the service or other users. The administrator may suspend or terminate an account for misuse, with or without notice where safety or legality requires it. Termination does not remove your right to request deletion or a download of your data under the Privacy Policy.

5. Emergency calling (911 / E911) — read this

In plain language: do not count on this app for 911. Use a regular phone for emergencies.

Emergency calling (911 / E911) over a PBX app has not been tested end to end and must not be relied on for emergency calls. Location information may not be transmitted correctly, calls may fail if the server, network, or power is unavailable, and emergency services may not receive your location. Always use a traditional telephone or mobile phone for emergency calls. By using the app you accept this limitation.

6. As-is software, no warranty

OwnPBX software and the app are provided "as is", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent permitted by law, consistent with the GPL-2.0-or-later license under which the software is distributed. The project does not warrant that the service will be uninterrupted, error-free, or secure, or that any data will never be lost. You are responsible for backing up anything important.

7. Limitation of liability

To the fullest extent permitted by law, the OwnPBX project, its contributors, and the project operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of (or inability to use) the site, the app, or a PBX account — even if advised of the possibility. Nothing here limits liability that cannot be limited by law.

8. Changes

These terms may change. Material changes will be posted here with a new "Last updated" date, and account holders will be told through the account portal or by email. Continued use after a change means you accept the new terms.

9. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Nothing here affects rights you cannot waive under the law that applies to you, including California privacy rights described in the Privacy Policy.

10. Contact and non-affiliation
